These Terms of Service ("Terms") govern your access to and use of the website https://www.divebarlic.com and related online services operated by Wolfe LIC Inc. d/b/a Dive Bar LIC ("we," "us," or "our"). By using the Site, you agree to these Terms.
1. The Site
The Site provides information about our bar / restaurant, menus, events, reservations, and related offerings. Content is for general information and may change without notice. We do not guarantee that online information (hours, prices, availability, event details) is always current.
2. Eligibility and acceptable use
You must be able to form a binding contract under applicable law. You agree not to misuse the Site, attempt unauthorized access, interfere with security or performance, scrape or harvest data except as allowed by robots rules and ordinary browsing, post unlawful or infringing content, or use the Site for any purpose that violates New York or federal law (including underage alcohol sales rules).
3. Accounts, reservations, events, and orders
If you create an account, book a reservation or private event, join a waitlist, buy tickets, order online, or subscribe to marketing, you agree to provide accurate information and to the separate terms of any third-party platform we use (for example reservation, ticketing, ordering, or payment processors). Event deposits, cancellation windows, and house rules are as stated at booking or on the Site.
4. Intellectual property
Site text, branding, logos, photos, menus, and design are owned by us or our licensors. You may view and share links for personal, non-commercial use. You may not copy, scrape for commercial reuse, or create derivative works without written permission.
5. Third-party links and tools
The Site may link to or embed third-party services (ordering, maps, social, payments, analytics). Those services are governed by their own terms and privacy policies. We are not responsible for third-party sites.
6. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US (IF ANY) FOR THE ONLINE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.
8. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Site or violation of these Terms, to the extent permitted by law.
9. Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Exclusive venue for disputes arising from these Terms or the Site lies in the state or federal courts located in New York County or Nassau County, New York, unless a mandatory consumer venue rule applies.
10. Changes
We may update these Terms by posting a revised version on the Site with a new effective date. Continued use after the effective date constitutes acceptance.
